Terms of Service

1. Acceptance of Terms

By creating an account on DawaTrack, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are registering on behalf of an organisation, you warrant that you have authority to bind that organisation.

2. Description of Service

DawaTrack provides a multi-tenant, cloud-based management platform for pharmacies, clinics, hospitals, dispensaries, and veterinary practices. Features include inventory management, point-of-sale, prescription tracking, purchasing, financial reporting, and supplier integration. Features may change over time; we will notify you of material changes.

3. Account Registration

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately at dawatrackmanagement@gmail.com if you suspect unauthorised access.
• One account corresponds to one pharmacy/facility tenant. Additional branches are managed within your portal.

4. Subscription & Billing

• New accounts receive a 14-day free trial. No payment method is required to start the trial.
• After the trial expires, a paid subscription is required to access the platform.
• Payments are processed in Kenyan Shillings (KES) via Safaricom M-Pesa STK Push.
• Subscription fees are non-refundable except as required by applicable law or as stated in a written agreement.
• We reserve the right to modify pricing with at least 30 days' notice to active subscribers.

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of applicable healthcare regulations.
• Upload or distribute malicious code, spam, or content that infringes third-party rights.
• Attempt to access, probe, or disrupt systems or data belonging to other tenants.
• Reverse-engineer or attempt to extract the platform's source code.
• Resell or sublicense access to the platform without our written consent.

6. Data Ownership & Portability

You own all data you enter into the platform. We process it solely to provide the service. You may export your data at any time using the built-in data export feature. Upon account termination you may request a final export within 30 days; after that period, data will be permanently deleted.

7. Regulatory Compliance

You are solely responsible for ensuring your use of DawaTrack complies with all applicable laws and regulations, including (without limitation) the Pharmacy and Poisons Act (Kenya), the Kenya Health Act, and any data protection legislation applicable to your jurisdiction. DawaTrack provides tools to assist compliance but does not guarantee regulatory approval.

8. Service Availability & SLA

We target 99.5% monthly uptime for production services, excluding scheduled maintenance windows (announced at least 24 hours in advance). We are not liable for downtime caused by factors outside our reasonable control, including internet outages or third-party provider failures.

9. Limitation of Liability

To the maximum extent permitted by law, DawaTrack's total liability for any claim arising out of or relating to these Terms shall not exceed the subscription fees paid by you in the three months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits or data.

10. Termination

Either party may terminate the subscription at any time. We may suspend or terminate your account immediately if you breach these Terms or if continued operation poses a security or legal risk. Upon termination, your right to access the platform ceases immediately.

11. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

12. Changes to These Terms

We may update these Terms. We will notify active account holders by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
